As of December 1, 2025, my right-hand person, Anita de Wit has retired and I have downsized my practice and am only conducting mediations where parties have counsel, generally by Zoom although special arrangements may be made for in-person sessions.


WHAT TO EXPECT AT MEDIATION

Both sides are represented by a lawyer.

The mediator is not a judge

The mediator is neutral.

The mediator’s role is to “leave no stone unturned” in search of a settlement.

The mediation is completely confidential.

There are no joint meetings – the mediator “shuttles” between the two teams.

Time spent with each side may not be equal. Some individuals take longer to express themselves than others.

The mediation will take place on Zoom unless special arrangements are made in advance.

Third parties can only be present with the permission of the other side.

All parties, including counsel, paralegals, and articling students, present at the mediation sign a commitment to keep the proceedings confidential.

At the outset of the session the mediator conducts a confidential mandatory screening for family violence with each party in the presence of their counsel.

The objective of the mediation is to end the session with a signed and legally binding Memorandum of Settlement which counsel will use as the basis of a Final Consent Order or Separation Agreement.
